David Hart QC of 1 Crown Office Row has been a barrister in private practice for 25 years. For nearly 20 of them, he has been an environmental lawyer, and has appeared in on waste management issues in the High Court (SRM), Court of Appeal (insurance coverage dispute arising out of the Loscoe explosion) House of Lords (United Utllites), and European Court of Justice (Thames Water).
He has a particular expertise in the defence of group actions (usually for odour) brought against landfill operators. He appears in criminal cases about waste in the Magistrates and Crown Courts. He regularly acts for planning and environmental consultants, engineers and lawyers on claims arising out of waste and contaminated land issues (e.g. Chatham Dock).
He also has a busy regulatory advisory practice, being consulted by both industry and the Environment Agency.
